GDPR data protection information for applicants
Dear applicant!

The General Data Protection Regulation, effective since May 2018, provides for extended information obligations. Therefore, we, Besi Austria GmbH, Innstraße 16, A-6241 Radfeld/Austria, hereinafter referred to as “Besi Austria GmbH”, inform you in the following which personal data we collect from you in the event of an application and/or registration on the Besi Austria GmbH applicant portal. We will inform you about the purpose for which this data is used and/or processed and whom you can contact specifically if you have any questions.

Who is this data protection information addressed to?

This data protection information is intended for persons (hereinafter also referred to as applicants) who set up an applicant profile with us, Besi Austria GmbH, in the course of an application for a specific position or on their own initiative.

For what purpose do we process your data?

We process your data as part of our recruiting process (personnel search and selection) to fill vacancies and to keep a record of your application documents. You can apply for a specific position or send us an unsolicited application. We will then contact you and inform you about the next steps in the recruiting process. The handling of this process is supported by our recruiting software “E-Recruiter”.

If, in addition to this data protection information, you accept the separate, voluntary declaration of consent, we will also keep a record of your data beyond the recruiting process and the subsequent retention period of 6 months. This will enable us to inform you directly about future vacancies, if applicable, and at the same time offer you the opportunity to apply to us again at a later date with your personal applicant profile.

On what legal basis do we process your personal data?

The personal data you provide is required to carry out pre-contractual measures. You are under no legal or contractual obligation to disclose your personal data. However, we cannot process your application or inform you about future vacancies without your personal data.

Furthermore, your personal data is processed for the fulfilment of legal obligations and for legitimate interest in connection with the assertion, exercise or defence of legal claims (e.g. claims under the Equal Treatment Act).

What personal data do we collect and process?

The following categories of data are collected during the creation of the applicant profile and subsequently processed:

• Registration data (e.g. creation/update date, applicant source, login, password)
  
• Personal data (e.g. first and surname, gender, age, date of birth, photo)
  
• Address and contact details (e.g. address, telephone number, email address)
  
• Application documents (e.g. CV, cover letter, references)
  
• Data on your professional experience (e.g. information on your previous jobs, references)
  
• Data on your education (e.g. information on school or university degrees, additional qualifications)
  
• Job requirements (e.g. job profile, job description, desired scope of employment, notice period, salary expectations)
  
• Other skills and qualifications (e.g. additional training, certificates, languages or hobbies)
  

In the course of the further recruiting process, your data will be supplemented by one of our recruiters with additional information, e.g. as follows:

• Interview dates, interview notes and comments on your profile
  
• Applicant correspondence with the relevant manager for the advertised position
  
• Indexing and additional job profiles to make your profile easier to find in the applicant database
  
• Additional posts that we suggest to you (provided you accept the separate voluntary declaration of consent for this)
  

Please note that health data, information on racial or ethnic origin, political, religious, trade union affiliation or sexual orientation are among the types of data requiring special protection. Therefore, we ask you not to transmit such data to us.

Accuracy of your information

Only with correct information can we process your application appropriately. By submitting your application, you confirm that the data you have provided is complete and that all the information contained therein is true.

Is any profiling carried out?

No part of our recruiting process is automated in a way that lead to applicants automatically dropping out of the application process. Decisions regarding personnel search and selection are always made by the responsible staff. To make it easier to find your applicant profile in our applicant database using the integrated search function, it is indexed and linked to matching job profiles.

Who has access to your data?

Your personal data will only be collected and processed by us for a specific purpose (see above) and made accessible to the respective responsible employees. Access is strictly regulated and usually only extends to recruiters as well as the management and key staff of the relevant departments. Our employees are obliged to comply with data protection laws and to maintain confidentiality and secrecy.

Technical service providers:

External data processors or other cooperation partners only receive your data insofar as this is necessary for the processing of the contract or we have a justified interest in doing so, which we always disclose separately in the event of an incident. If one of our processors comes into contact with your personal data, we contractually ensure that they comply with the provisions of the data protection laws (e.g. security, confidentiality) in the same way as we do.
For the handling of our recruiting process, we commission the manufacturer/lessor of our recruiting software as well as hosting providers who provide us with servers for the software operation.

Other recipients:

In order to comply with legal obligations or to defend legal claims, we may need to grant authorities or courts access to your data on a case-by-case basis.

What rights do you have?

Due to the General Data Protection Regulation, you have the right of access, withdrawal to rectification, and erasure of your personal data, among other things. Below we would like to explain some of these rights in more detail:

Your right to of access and to rectification

You will of course receive access to information about your personal data that is collected and processed by us. If your data is no longer accurate or incomplete, you can edit it yourself via your applicant profile or request rectification and/or completion.

Your right of withdrawal and erasure of your personal data:

You can withdraw your consent and exercise your “right to erasure / to be forgotten” at any time. In this case, we are obliged to erase the personal data relating to you. The withdrawal of consent shall not affect the lawfulness of the processing carried out on the basis of the consent until the withdrawal is received.

As an applicant, you can exercise your data protection rights centrally with us at the email address hr.besiaustria@besi.com.

If you believe that the processing of your data violates data protection law or your data protection rights have otherwise been violated in some way, you have the option of lodging a complaint with the supervisory authority. In Austria, the data protection authority is responsible.

For how long will your personal data be stored?

In principle, we will retain your data for six months from the date of completion of an unsuccessful application process. There is the option, based on your express consent, to allow us to retain your application data and keep it on record for a further 12 months (see form declaration of consent).

In good time before the retention period expires, you will receive an email from us in which you can confirm (again) the declaration of consent in order to continue to use your profile and remain visible as an applicant. If you give us your consent (again), your applicant profile will remain active with Besi Austria GmbH for a further year. If you do not give your consent, your profile will be erased.

As described above, you can withdraw your consent at any time and request the erasure of your personal data. Please note that under certain circumstances, erasure may not take place immediately, but only after a certain period of time. This may be due to legal obligations or for the assertion, exercise or defence of legal claims.

Should your application be successful, we will keep your data collected in connection with the application process in any case for as long as there are legal retention obligations or as long as any legal claims have not yet become time-barred.

We reserve the right to erase the profiles of applicants whom we have not been able to inform about suitable positions for a longer period of time. If there is a vacancy that interests you at a later date, you can always create a new applicant profile.
